A Conflict Between State’s Rights and Individual Rights, Essay Example

There are times when conflicts exists between state rights and individual rights, such as rights related to bearing arms, same-sex marriage, legalizing marijuana for medicinal purposes, being disabled, etc. This is something that has been going on for a long time; however, no matter what the states do, not everyone will be pleased. It seems that somebody’s rights will always be in conflict with state laws. An example of a conflict between state and individual rights is discussed by Kollas (2002) and relates to the discrimination of the disabled, even in light of the Americans with Disabilities Act (ADA). The purpose of this act is to accommodate the special needs of mentally and physically disabled individuals in all walks of life. However, there are times when this is challenged and must be handled in court (Kollas, 2002). Other conflicts can arise when people in the general public are concerned about state law that affects them, in which they may or may not necessarily agree with, such as the right to bear arms. There are people on both sides of this issue; however, the law is as it is and those who do not agree with it feel like their individual rights are being violated. But, if the law is overturned, then those on the other side will feel like their rights are being violated. I think that conflict definitely exists but it will always be there, because nothing will be able to please all the people.
