Articles of Confederation and the Constitution, Essay Example

Introduction

In general terms the Articles of Confederation were considered to create a weak central government. This as opposed to the US Constitution that created a strong central government. Under the Articles there did not exist a federal court system and as such Congress were unable to levy taxes or enforce laws without approval from the states. In addition it failed to legislate trade between the states and other foreign nations. The constitution set about putting these shortcomings right. The following table sets out the main differences between the Articles of Confederation and the Constitution.

Setting of Taxes

Under the Articles of Confederation Congress only requested individuals to pay taxes. The Constitution changed this empowering Congress with the ability to levy taxes on individuals. It was the concept of gaining a Federal control over taxation as opposed to individual state control that would lead to disputes. This had been a significant issue between the early colonists and the British occupying forces.

Legal System

Under the Articles of Confederation there was no court system in place. The Constitution put in place a Federal Court system empowering congress over the states. It provided a hierarchy in the judicial system and the formation of a supreme court.

Trade Regulation

Under the articles the congress had no control over commerce between the individual states and other foreign powers. The constitution put in legal regulations to control trade between states.
