Policy Analysis in Helping Judges Implement the Common Morality System

Conflict of interest presents a significant threat to judges in issuing verdicts and conclusions regarding a case. In this context, the judge’s parents have an attorney representing the former corporation. The attorneys have failed to appear in recent sittings citing a conflict of interests as the judge resettles the matter. From an ethical perspective, the judge should consider the policy of rescuing himself by informing the parties of the prevailing conflict of interest. It implies that the judge will find it difficult to conclude the legal matter without separating emotions and feelings from reason. This common morality system acknowledges the human criticality and challenges that judges and attorneys experience. Most importantly, the policy is instrumental in protecting the integrity and impartiality of cases that depict a conflict of interest between the presiding judge and arguing parties.

Moreover, the rescue strategy should be substantiated with fundamental reasons which inform the parties involved of the judge’s position. He/she should consider a convincing and elaborate process that involves all parties inclusively and comprehensively. The rescue policy, most importantly, should be applied across major legal cases that bring together the judge and the attorneys. This is critical in preventing and removing barriers impeding impartial justice dispensation. Specifically, the involvement of the same attorneys in other cases with the same judge raises questions regarding implementing the morality system. It will be difficult for the judge to evaluate and analyze other cases with his parents’ attorneys representing them in the same court regarding their corporation. The rescue strategy should ensure that values and principles of ethics and morality in law are integrated for this case. Most importantly, the judge should look beyond the ongoing corporation case and evaluate his relevance and significance in ensuring accountability in future cases not involving his parents.
