Although the proposed study may be important in assessing the incidence rate of HIV/AIDS in children, there is little possibility the study will be approved. Federal regulations require that research investigators obtain the permission of a parent in lieu of receiving direct permission from the subject (Health Care Partners, 2010).  In this case because the subject cannot give consent  (as an unborn baby), research investigators should seek the parent’s permission to participate in the study (National Cancer Institute, 2005).  In addition, since HIV/AIDS is usually part of a state surveillance system, if the child does test positive for HIV/AIDS , the health department would likely test the mother as well, making her aware of the previous testing.

The findings of the study will effectively be null and void by the IRB, if there is one, after the study is finished.  The IRB is in charge of insuring that the participants gave consent in order to participate in the study.  If I was asked to participated as a data collector in the study, I would likely refuse to be involved in the data collection process.  Since the study does not adhere to the proper protocol, and will likely by refused or shut down by the participating IRB, I would not want participation in the study to negatively affect my career prospects.
