Essay

The main agenda of the Obamacare is to ensure the provision of affordable health care services. In my view, the Supreme Courts outcome was appropriate, as individuals should buy health insurance before they fall sick rather than after they become sick. The opponents of Obamacare argue that the congress does not have the authority to levy individuals to buy health insurance.

The Obamacare aims at the provision of an affordable health according to its proponents. The Supreme Court upheld the constitutionality of the bill as it argued that the mandate to buy medical insurance was constitutionally justified, as the resulting penalty of violation would be a tax. According to Obama, the Congress and the court the mandate does not fall into the category of tax for purposes of jurisdictional statutes. The Supreme Court, however, treated the same as tax since the same becomes payable to the IRS and there are no other legal repercussions as long as the mandate remains paid. In the political view, the decision acts as a victory for the liberals who have continuously pushed for the provision of affordable health care services.

On the other hand, the opponents of Obamacare dispute the authority of the federal government to impose the mandatory purchase of health insurance. According to the arguments of the conservatives, the mandate cannot be justified. The Republicans opposed to the Obamacare on the grounds of the authority of the Congress to legislate on issues that control the lives of individuals. In this case, the position is that the federal government should not control the lives of individuals, which in this case involve compelling them to a mandatory health insurance cover.
