Patent Pilot Program Could Cut Litigation Costs, Essay Example

Pages: 1

Words: 288

Essay

While many companies are unable to have successful business partnerships with the government, the article “Patent Pilot Program Could Cut Litigation Costs” explains the advantages of making this relationship work. This article explains the government’s attempt to speed up the litigation process by assigning judges to similar cases with the hope that their expertise in their individual area will help speed along hearings. In particular, this helps businesses because the government will be helping them speed up these matters, which may mean either more patents or a greater chance to profit from a patent more quickly. Furthermore, when businesses identify companies that are not behaving in accordance to their patent, they will be able to address this violation more quickly.

Many state governments have agreed to participate in this program and the article demonstrates that this program has been somewhat successful thus far. In short, this program has actually helped speed up the patent litigation process. Furthermore, it has been shown that a majority of non-patent judges are willing to give up patent cases so that specialized patent judges may take their place. However, for this program to be truly successful it is important to make it a standard; perhaps cases should be assigned to professional judges for their particular case across the board. In this manner, more states will become a part of this program, and businesses will be able to grow as a consequence. Overall, this concept is favorable because when businesses do well, the economy does well and more jobs are available. Thus, non-participating states have incentive for implementing this program in their own way. Ultimately, it is likely that it will prove successful.
