This article informs of a recent charge made by the Federal Trade Commission against the company and makers of Pom Wonderful juice. The F.T.C. claims that the company and its makers made false and unsubstantiated medical claims about their product to the public. In response, the makers of Pom Wonderful have sued the Commission, claiming that it had exceeded its authority and was violating Pom’s First Amendment Rights. The topics covered in the article include legal rights of companies to make health claims, other legal troubles faced by the Pom company and its employees, and government rights in protecting the public from potentially inaccurate information. The source appears unbiased because it presented the information objectively, as well as obtained commentary from both sides of the issue. This article relates to our course because it displays one of the various ways in which the government works to protect consumers from private sector actions and claims.
