Today, the United States Food and Drug Administration banned further sale of the intelligence-raising product appropriately labeled as “Smart Ear.”  The product was advertised as being one of the few devices on the open market that could actually increase a person’s intelligence immediately upon wearing it.

The FDA and the United States Federal Trade Commission issues a cease-and-desist order against Smart Ear International and its president, Rocky Fuginaka.  The order declared that there must be an immediate termination of all sales for the “Smart Ear” device effective immediately.

The order has come into effect following the appearance of over 24 customers in Des Moines, IA, and Dallas, TX, that have all developed a highly fatal flesh-eating bacterial infection.  The infection, according to the FDA, is a direct result of wearing the “Smart Ear” device.

Upon learning of the infections, the cease-and-desist order was approved by the U.S. District Judge Alonzo Mourning.  Three of the infected individuals have died as of last night, and several more are in critical care in government-sponsored hospitals.

Smart Ear International is fully cooperating with the investigation. Fuginaka has been unavailable for comment to the press; however, Smart Ear International has made an official statement that “no such infection has occurred in any of the 36 countries around the world where customers have purchased Smart Ear devices.”

Consumers that have purchased devices or placed orders through Smart Ear International are urged to return the product or cancel the orders immediately.  Smart Ear International has stated that it will fully cooperate in giving all American customers immediate refunds if they were unsatisfied with the product.  Details for returning the product can be found at the Smart Ear website www.smartear.com.
