Case Brief

Via and CN are two of the operating railway companies with an established route along the highway. It is said by the government that it is because of the negligence of these two companies that highways 5357 and 369 were damaged and has caused massive disturbance on the supposedly continuous flow of mobile traffic within the said area. It has been reported that because of the lack of attention that the companies put upon the weight of the cargo that they are carrying through the railway, the derailment of their railways became evident; and when it actually happened, the problem it caused was rather massive and disturbing in travel.

Details of the Case

The local government pushes for a $2 million lawsuit against Via and CN, accusing the companies of negligence of their duty to the public and to the government. It has been realized through investigation, the derailment of particular railways operated by these companies have actually caused massive damage on large areas of the Saskatchewan highways. These damages were considered disturbing and have caused so much loss on the part of the local government. This definite turn of situations has caused so many disturbances, and somehow, it is this disturbance that would make a definite turn on how the emergence of what this case is about and how it should affect the being condition of thinking of business operators at present.

This case focuses on damages that happen when a single organization does not comply with the responsibilities that it has to recognize as part of its existence. Most often than not, these damages are unlikely acknowledged especially by the administrators themselves. When the plans are completed and are executed by these business organizations, it would be likely that the option of development is seen to have a great benefit to the organization; that somehow, the risks and the negative matters that would come out from such operation. Most often than not, business operators see such conditions of negativity at a much later time; mostly, when it is already late and somehow the damages have already been done.

This is where the complication of matters comes into account; when public agencies come into the picture and push for the condition of return that the public needs from the companies involved in a case. Noticeably, in this case, it was rather obvious how a definite turn of events actually hurt the manner by which the companies originally aimed to operate for the public. Most often than not, these types of cases cost much more during the process of settlement, rather than on the possible hope of fixing the situation even before they happened. This is where proper project management comes in; most likely, it is hoped that with this option of company development, mangers would be able to seek a definite turn of situations, setting their goals even more focused; likely giving them the chance to avoid any more source of risks later on.
