Sudson Sues Letisha, Essay Example

Pages: 1

Words: 330

Essay

In the event Sudson sues Letisha, several arguments could be raised to defend her against the renewal clause. In some states, the clause is not valid unless the lessor sends the lessee a separate document advising the latter on the provision. The notice has to be delivered to Letisha 15 days or 30 days to the date of renewal. In his case, Sudson does not follow this and so the renewal is not valid.

Sudson could raise the following arguments to support his argument. Letisha signed the contract after reading it. In this case, it is binding considering she read it and agreed to sign. Sudson would then argue that Letisha did not write to him to terminate his services as agreed in the signed contract (Griggs et al., 2008).

The ethical issue in question is the period that the automatic renewal should stay binding. In most standard contracts, the renewal period is one month. Automatic renewal cannot be fifteen years as seen in this case.

Uniform Commercial Code Article 2A is applicable in this case. Sudson (lessor) has allowed Letisha (lessee), the right to use his goods for an agreed period at a fee (Howells, 2005).

Entities are available for consumers to file any form of complain. For instance, in Virginia, the attorney general’s office serves as the centre for evaluation, referral, and investigations of any complaints lodged by consumers (Cseres, 2005). Even so, this office does not encourage all manners of complains, and as such, it encourages people to file their complaints in court.

In the event Sudson sues Letisha, the court will rule in the favor of Letisha. The court will consider the period of the automatic renewal and will charge Sudson with unlawful business practices (Blum, 2007).
