Telehealth technology has been increasingly used as a means of providing healthcare services to patients, especially during the COVID-19 pandemic. The use of telehealth technology raises ethical, legal, and safety concerns that need to be addressed to ensure that patients’ privacy and confidentiality are protected. This paper aims to identify the various ethical, legal, and safety considerations applicable to telehealth technology and highlight the two major challenges in protecting patient privacy regarding healthcare information in today’s healthcare climate.

Telehealth technology refers to the use of digital communication tools and electronic information technologies to provide healthcare services remotely (American Telemedicine Association, 2018). This includes videoconferencing, remote monitoring, mobile health apps, and other digital tools that allow healthcare providers to communicate with patients and remotely manage their care. (American Telemedicine Association, 2018) Telehealth technology is a rapidly growing field that has gained significant momentum in recent years, particularly in response to the COVID-19 pandemic, which has accelerated the adoption of telehealth services as a means of providing safe and accessible healthcare to patients. (American Telemedicine Association, 2018)

One of the primary benefits of telehealth technology is its ability to overcome geographic barriers to healthcare access, particularly in rural areas where there may be limited access to healthcare facilities and specialists. (American Telemedicine Association, 2018) Telehealth technology can also help to address the shortage of healthcare providers in certain areas, as it allows providers to deliver care remotely and extend their reach beyond their physical location. (American Telemedicine Association, 2018)  Additionally, telehealth technology can improve healthcare efficiency by reducing travel time and wait times for appointments, and by allowing providers to monitor patients remotely and detect issues before they become serious. (American Telemedicine Association, 2018)

However, the use of telehealth technology also presents unique challenges, particularly with regard to patient privacy and security. For example, the use of telehealth technology raises ethical considerations, such as the potential for patient harm due to misdiagnosis, incorrect prescriptions, or inadequate monitoring of symptoms.  (American Medical Association [AMA], 2021) Providers must ensure that the quality of care provided through telehealth technology is equivalent to that provided through in-person visits. Ethical concerns also arise regarding the potential for biased decision-making based on race, gender, or socioeconomic status, which means that providers must be aware of the potential for bias and strive to provide equitable care to all patients (American Medical Association [AMA], 2021).

Moreover, telehealth technology is subject to legal considerations such as licensure and liability. (Centers for Medicare & Medicaid Services [CMS], 2021) Providers must ensure that they are licensed to practice in the state where the patient resides. They also must be aware of the laws and regulations that govern telehealth services, such as the Health Insurance Portability and Accountability Act (HIPAA) and state telehealth regulations. Liability concerns arise when there is a breach of confidentiality or when there is a failure to diagnose or treat a patient’s condition. Providers must ensure that they comply with these regulations to avoid legal implications (Centers for Medicare & Medicaid Services [CMS], 2021).

In addition, safety considerations arise in telehealth technology due to the potential for technical issues, such as poor audio or video quality, which can lead to miscommunication between the provider and the patient. Providers must ensure that the technology used is secure, reliable, and user-friendly. Providers also need to have protocols in place to address emergency situations and ensure that patients receive timely and appropriate care (AMA, 2021).

One of the key concerns is the general question of privacy. The use of telehealth technology presents challenges in protecting patient privacy, including the following:

Data Security: Telehealth technology generates a large amount of patient data that must be stored and transmitted securely. Providers must ensure that patient data is protected against unauthorized access, theft, or hacking. The use of secure servers, encryption, and password protection can help to mitigate these risks. However, data breaches can still occur, and providers must be prepared to respond quickly and effectively to minimize the impact on patients (AMA, 2021).

Lack of Control over Technology: Patients may use their personal devices to access telehealth services, which can pose risks to their privacy. Providers have limited control over the security of patients’ personal devices and must rely on patients to take appropriate security measures. Providers must educate patients on the risks of using personal devices and provide guidance on how to secure their devices (CMS, 2021).

Thus, telehealth technology presents ethical, legal, and safety considerations that must be addressed to ensure that patients receive high-quality care in a secure and private environment. Despite the obvious benefits of telehealth technology, the challenges of protecting patient privacy in the telehealth industry include data security and lack of control over technology. Providers must take steps to address these challenges by implementing robust data security measures and educating patients on how to secure their devices. By doing so, providers can ensure that patients’ privacy and confidentiality are protected, and they can provide high-quality care through telehealth technology.
