In today’s world, where most of the Western countries have an administrative state, it is important to reflect on how the interest of people is represented by different powers. The Framers of the Constitution created a system that had balances, checks, and assurances for the separation of powers built in. However, the powers in modern America are still not balanced, with more power assigned to executive and judicial agencies . Overall, it is evident that legislative power has more importance in decisions that affect people’s lives than any other government branches. While the President (executive branch) has the power to veto the decisions of the Congress, it is the Congress that can amend the Constitution, provided that two-thirds of states approve the changes.

Overall, initially, the separation of powers into three branches was designed to ensure the best representation of residents of the United States. The Congress was assigned the power to create laws, the President was given the authority to enforce the law (executive branch), while the Supreme Court was created to have the maximum juridical authority.

According to the Constitution, the  President has the authority to appoint all the principal officers, and the members of the executive branch. The President – through this authority – is able to extend his personal power. This also means that the President would appoint executive branch members who are from the same party as him. While there are checks and barriers built in the system to prevent the Executive Branch from becoming too homogenous, and the President needs to delegate appointments.

Congress has recently lost its power to deal with constitutional issues, and legislation. The Congress today is more like an overseer of the other branches than a legislator. Therefore, the Congress appears to be the weakest branch, as it lost its power to the executive branch.
