The Right to Education for All Children, Essay Example

IDEA or The Individuals with Disability Act (1975) can be considered as federal law   that protects the right of a child who is suffering for disability. This law allows him. /her to obtain free and appropriate public education  and the law has six principles. IDEA is fundamentally directed or imposed upon the states that carry the burden of providing education to the citizens.

Principle under Discussion

Zero reject:

According to the “Zero Reject” principle of IDEA, it is compulsory to teach all children who are suffering from disabilities. It is interesting to note that the opportunity of education is not limited or restricted by the nature of the disability and such that no child with disabilities can be rejected form admission to public school.

The regulation also stipulates,” The requirement to provide especially education to all students with disabilities is absolute between the ages of 6 and 17. If a state provides educational services to children without disabilities between the ages of 3 to 5 and 18 to 21, it must also educate all children with disabilities in those age groups. Each state education agency is responsible for locating, identifying, and evaluating all children, from birth to age 21, residing in the state with disabilities or who are suspected of having disabilities. This requirement is called the child find system.”(Heward, 2013).

This can be declared as one of the major cases upholding the law and the points declared to the residents of the country. On this note, Timothy was the plaintiff who was really unable as per medical records. As per the court statement, Timothy W. was born two months prematurely, and he suffered a lot of problems because of his illness. He did not receive any support from the school. The school management did not allow him to attend the classes and declared him an educational handicapped. His mother provided him services and worked hard for him. “(JUSTIA US LAW). He did not receive any favor from school management and felt really disappointed. After many treatments, he has shown some improvements and started taking part in daily life activities.

The chances of admission of Timothy to educational institute or at least facilitate him with education became a serious problem for the school management since that declared that Timothy was too unable to attend the classes (Norman, 2002). After so many repeated requests done to the school management, it was changed and treatments other preventive actions started showing some progress/ improvements. On a shocking note, the School came up with the statement that, the child was not educationally ill, but he has to go through some treatment for better performance, the team declared that with the help of teachers and other colleagues, the child can get education.“(JUSTIA US LAW)” After prolonged court hours, judgement was in favour of Timothy and thus upheld the Zero refusal procedure of IDEA. The court judgment favored him a lot and these hearings give him strength and power to look ahead in life. Spending life with illness is tough but not impossible; one can make his own path with courage and hard work.
