There are laws and regulations put into place to protect marketing companies and the target consumer equally. This is no different when it comes to advertising for political parties as well. In fact, the regulatory requirements prove to be quite restrictive when it comes to dictating a “vote for” or “vote against” marketing campaign. This issue has surfaced because the candidates have a specific amount of monies available for their campaigning. However, if outside funders create the ads, the political party is void of the regulatory funding specifications. This clearly was a long-term and highly debatable issue associated with marketing. This article addresses both sides of the argument in a highly-controversial presentation of falsifying funding or the practice of free speech.

The article has a significant amount of news worthy effectiveness. Politics are an important part of society and the foundation of America. It is also notorious for being shady, and misrepresenting the facts. Because politicians are known for ‘lying’, the actions they take for being elected or reelected are highly scrutinized as well. This is why this article and the controversy that coincides with primarily focuses on Wisconsin Club for Growth and right-wing media, which leads the audience to believe that this entire investigation is groundless. However, the facts presented in the multiple press releases would lead the reader to question the validity.

This article has proved to be unfavorable for Wisconsin’s Laws and political regulatory bodies. Judge Randa deemed that issue ad coordination was not subject to the same laws and regulations as other political areas. “The facts tell a different story, one of serious concern by both Republican and Democratic law enforcement officials that the recall elections involved illegal activities in violation of Wisconsin laws.” (Fischer, 2014)  Therefore the original ruling that found no wrong doing was not truly factual and did not hold the merit originally believed. This just aids in the public’s view of Wisconsin’s actions and their hiding or misrepresenting themselves in illegal political activities that is being covered up on a much higher level.

This article’s newsworthiness is valid. This shows a lot about the legalities associate with marketing and politics alike. It takes that grey area of expenditure and contributions and twists it to the favor of politics which creates a highly controversial situation. “[S]peech which does not expressly advocate the election or defeat of a clearly identified candidate may, nevertheless, be subject to campaign finance regulation,” the GAB wrote in the advisory opinion. Utilizing the legalities of freedom of speech does not deem it void of being regulated by the political laws set in place for fair campaigning. Finding a loophole does not mean it is legally acceptable or right, it merely demands a revision of the existing laws.

Clearly there is a large room for interpretation and when that occurs, the potential for misrepresentation is high. In this situation it is taken to a legal level and challenged the entire way. The laws and regulations that were set for political marketing allowed room for being manipulated, and this created grounds for debate and questioning the judicial system in its entirety. This newsworthy article was very informative and opened the door for understanding greater depth of legalities associated in marketing.
