Based on EC book Chapter 7, Review Question 4 (RQ4) in page 342, please explain what a warranty disclaimer is and describe the circumstances under which a company that is doing business online might want to use one.

In the field of internet marketing and eCommerce, the idea of legal liability and responsibility likewise apply particularly in the part involving commitment and sale transaction. In the course of the business activity of the merchant , there is a concept of implied warranty in which the merchant is supposedly liable or responsible to the state and condition of the product being sold in the website business transaction ensuring clients that each goods sold through the said service is in good quality commensurating to its monetary value. On the other hand, the idea of creating a warranty disclaimer for the merchant somehow counteract any unwanted liabilities that could arise from the implied warranty that is beyond the control and interest of the said party.
The warranty disclaimer in the course of eCommerce is basically a legal statement or contract supplement given by the merchant that applies to each of its transaction, products, and warranty claim. In the warranty disclaimer, the client can waive its responsibility on the implied warranty if the circumstances that caused the application of the latter concept is within the indicated scope of the warranty disclaimer. In its application, the merchant can specifically narrow its warranty scope only on matters that are within their control particularly on their aftersales services.
For a merchant that is conducting business through the internet, creating and clearly establishing its warranty disclaimer is an important concern. For businesses that are selling goods and services online, control over their products aftersales is indeed limited thus, yet an implied warranty on such products still exists. Indeed, to clearly delineate and clarify their responsibility, they must apply a warranty disclaimer declaring their responsibilities only on circumstance within their possible control and concern.
