YES. Many people would actually agree with this statement. The reason behind the statement is the need for rehabilitation. Jacob Ind’s reason for saying this is simply ‘reason for murder’ why kill? I his case for instance, he believes that the reason was justified and sane and an investigation and inclusion of emotional dynamics should not be ignored in the formulation of a judgment. This labeling is very problematic because it may lead to the imprisonment of innocent people in the eyes of the spirit of the law.

The mitigating factors in this case are the fact that Jacob and his brother Charles had gone through years of sexual and physical abuse by their parents. Jacob so no way out. The mother made clear that she hated him and never bothered to defend him from the step father. The fact that was detached from the reality of killing his parents also shows that the intent was innocent. Jacob should have had a more lenient sentence because the murder of the parents Pamela and Kermode Jordan was actually caused by their illegal actions.

The treatment of juveniles as adults in Colorado was greatly influenced by the media. The media played the role of informing the public on the event of ‘the summer of violence’ in which juveniles did a lot of evils especially at home to their parents. The spread of fear and concern put pressure on policy makers especially where extreme cases were just dropped due to lack of constitutional guidance. Debates in the media and responses from concerned adults as expressed in the media only served as a catalyst for the new approach.

Two months before Erick Jensen’s trail he had been arrested as an accessory to the murder of Nate’s mother Julie who had been murdered by own her son Nate. Erik however, had been released on bail. Erik found Julie injured after being hit by Nate with a pair of fire place tongs. He however did nothing about it but instead in his own words ‘Basically just went along with the flow…’the ‘flow’ here being conspiring to conceal the event. This affected the jury’s decision especially as it seemed very intentional.
