Introduction

AIDS discrimination and stigmatization of patients living with HIV occur worldwide, although they occur across communities, religious groups, countries, and individuals. They occur in very many forms including; ostracism, rejection, discrimination and can be directed towards individuals and restrict them in undertaking certain activities or participating in social activities such as the case of Adam doe who was denied the opportunity to pursue his dream in basketball.

The discrimination directed towards Adam doe that denied him the admission to Deer Mountain Basketball Academy by revocation of his registration is unacceptable and should be discouraged at all cost. Adam`s condition shouldn’t be a subject of discussion as an elimination criteria since this can have a huge negative impact in his life. Ultimately, he may be forced to leave home, change his daily activities to a more conservative lifestyle hence reducing his productivity and performance. He is likely to face depression, loneliness, and anxiety at his tender age of ten.

It is an unfortunate circumstance since stigma amplifies the complexities of living with the HIV. Adam`s rejection is a reflection of the fear and apprehension that is associated with the transmissible illness a situation referred to as instrumental AIDS stigma.

The court`s ruling to grant the plaintiff`s motion for summary judgment of ADA and NYHRL declaratory relief, as to Deer Mountain`s discrimination on the basis of Adam`s disability is certainly the appropriate step towards ensuring the rights and privileges of individuals living with HIV are not violated. This just course to allow every individual in the society equal opportunity and access to services improves the welfare of every individual as the society will be engaged altogether in participatory development.

Every woman has the right to children and the redress sought through artificial insemination provides them this opportunity of being a mother. The case of Octuplet`s mum where she was transferred eight embryos is unacceptable as it ultimately reduces the woman`s ability to nature and bring up the increased number of children. Legal action serves justice since disclosure of information to the patient is necessary and the failure to do so by a doctor is punishable by law as it accounts to service malpractice.

Conclusion

HIV related discrimination severely hinders efforts to effectively fight the HIV and AIDS epidemic. Discrimination increases fear and prevents people from seeking treatment or publicly admitting their status.A more enabling environment needs to be developed to increase the visibility of people living with the virus as a normal part of the society and in extreme discrimination cases legal redress could be used to assist in combating the vice.
