Whenever bullying is presented within a court case, the verdict is often difficult to come to. This is due to the fact that the use of laws for bullying just does not work because of the manner in which it is often difficult to prove that an individual is guilty or innocent. In addition to this, a bully’s victim might not want to fess up because he or she might be shy or be afraid of being humiliated by his or her peers. The fact the some individuals around the world let bullying go to such an extent as to having the victim of bullying injured says a lot about various individuals. What is meant by this is that bullying should be something that is resolved within a household, school, or wherever the bullying is taking place. Because of these contributing factors, for the government to implement laws regarding bullying is completely irrelevant and ineffective.
One of the main reasons as to why laws against bullying should be avoided at all costs is because if these laws begin to become implemented, individuals will continue bullying in secrecy. It is fair to say that light should always be able to be shed on bullying, because when it is, then there is potential to put a stop to it. As opposed to having the government prohibit bullying, bullying should be dealt with at once by certain school faculty and/or parents. Things should never get out of hand in the scenario in which an individual gets seriously injured only because he or she did not have the proper adults to take care of him or her. One of the best manners in which bullying can be brought to a stop is by having both parents and faculty raise awareness on the fact that making other feels degraded is completely wrong.
Because of the manner in which bullying can happen within any age group, laws against bullying would be irrelevant. This is said as such because a seven year old bully would never be punished in the same fashion that a seventy year old bully would by punished. In my opinion, once an individual begins to become hurt due to the bullying of other around him or her, this has now become a felony. Therefore, immediate consequences should be undertaken in order to ensure that the individual does not harm anyone else. However, most bullying cases can be solved by simply getting help from adults. Despite the fact that it might be intimidating to approach and adult and ask for help at first, over time, everything becomes so much easier. So much so, that individuals become to gain more confidence and start to ignore their bully’s insults.
Laws for bullying would only serve one single purpose: complicate the court sister. In addition to that, there would be a multitude of parents suing schools and other parents because they would have broken the law. What individuals must become cognizant of is that despite the fact that there are not specified laws against bullying, there are implicit laws against bullying. These laws go under the category of harming other individuals. If a parents or a teenager were to ever feel defenseless against a bully and he or she ended up hurting him or her, then the bully could immediately be taken to court. Through this, there would most probably be a verdict that the individual is or was found guilty of disrupting the peace. At times, if this individual were to be a teenager under the age of eighteen, then he or she would most probably be sent to a juvenile detention center. If, however, the bully-e was an adult, then he or she would most probably have to spend an extended period of time in jail.
Another factor that must be taken into consideration when thinking of implementing bullying laws into our court system is that even after a case was settled, who would take the fall? In other words, who would be held liable for the bullying of the children. The immediate answer to this question is often “the one committing the bullying”, but what if that individual was raised up believing that it was okay to push his friends into a locker? Taking this in mind, parents and school institutions would be held accountable for the bullying. Of course, this would be a long, tedious process. If this controversy can be avoided, it should be avoided at all cost. The reason as to a variety of individuals would be guilty of the bullying is because the bully would not be able to be completely punished if he or she was too young. Therefore, it has been proven that there is no true necessity for our court system to start implementing laws against bullying throughout the nation.
Bullying should be something that is resolved within a household, school, or wherever the bullying is taking place; for the government to implement laws regarding bullying is completely irrelevant and ineffective. Having said this, instead of making up laws to ensure the protection of those being bullied, more thought should be taken into this problem and easier solutions must be found. An example of a solution would be for teachers and parents to raise the awareness of anti-bullying so that they become cognizant of the actuality that bullying is not okay nor will it ever be okay. Not only that, but by raising awareness, more and more individuals will slowly come to realize that in order to put an end to bullying, everyone must be more than willing to collaborate and put in the hard work that is required.
