The Fair Employment Practice Act, Case Study Example

Pages: 1

Words: 368

Case Study

The ethical issue identified in this context is that the Fair Employment Practice Act’s (FEPA) implementation has never been questioned by individuals such as Irene, who are fearful that they would be labeled racists. According to Stan, the Act’s implementation is ironic since it discriminates against the state minorities the law was formed to protect. Stan gives an example of how the hiring agency can discriminate against females in a hiring protocol after a manifested hiring imbalance created by the same law. This would go against the company’s hiring goals and affirmative action plan.

The case in context explains the deontology ethical perspective where the society only interprets FEPA, not based on the product or outcome but because of the reason why the actions that the law explains to be morally correct. Stan explains to Irene why hundreds of attorneys have implemented the law without putting it into question because of their fear of being labeled racist. Stan explains why FEPA has the moral obligation to represent all minorities and not selectively, which means implementers need to consider its consequences to human welfare.

The major strength of Irene Mayer is that she is a good listener. She is not ready to jump to conclusions as she spears a few minutes to listen to Stan and understand his point of view. The major weakness is that she lacks the moral sense to interpret why the law was ironical in how it served the minorities. On the other hand, Stan is observant, as his keenness for detail led him to interpret the flaws that FEPA has in delivering social justice. As a leader, both Stan and Irene possess the needed communication skills which would allow them to communicate to their followers to initiate change and transform how the justice system has interpreted the law.

The best action for the case in context is for the state to fully understand the concept of social justice, which is the bedrock for which FEPA operates. Social justice is understood as the law’s interpretation and view that serves equal opportunities for all minorities in the community. The law needs to be amended to serve this fundamental principle, social justice.
