Although those who assault women and children should face punishment for the acts that they committed, resorting to the mutilation or sterilization is something that should be avoided by society.  While it may be argued that there is a sense of justice in doing this to people, then the sterilization process will be institutionalized into government.  Once these acts have been put into place and gain public support, it is difficult to determine how the representations of who should be affected by the process will develop.  In this way, it giving the authority to sterilize or dismember criminals makes it difficult to establish a moral grounds for judgment in the first place.  Through the application of these actions, moral punishment would be made irreconcilable with the actions of the state.

As these punishments are such that they cannot be overturned, they are definitely cruel and unusual.  While punishments such as jail time and public service take up the individual’s time, if they were later found to be innocent of their crimes then they would be able to be removed from the penal system without any lasting effects.  It is, for this reason, a good thing for capital punishment to be established based on the moral obligations of those within society.  These obligations extend to all members of society, not simply those who are able to possess a certainty of character.  This demonstrates the importance of reserving these types of punishments within civilized society.  The application of such punishments would seem to erode the moral character and authority of those who are committing judgement on the offenders.
